Since we followed the policy of reform and opening reform, the economy of China has developed rapidly. Along with development, industrial clusters have appeared fast, especially in the south and east coastal area and some economically developed regions of China. Because of the particularity of China’s economy and the interactive mechanism of innovation and agglomeration, intellectual property rights protection and marketization are considered two important factors influencing agglomeration. Then we should ask whether the increasing of the strength of intellectual property rights protection or the degree of marketization in our country will induce agglomeration on earth. The new economic geography mainly focuses on the interaction of technical innovation and agglomeration. And there have been already many results. Researches on the intellectual property rights or marketization always focus on the effect on the growth, neglecting the effect on agglomeration. And there is no research which analyses the relation between intellectual property rights protection, marketization and agglomeration within one framework.This paper constructs a theoretical model based on spatial economics. Then relation between intellectual property rights protection, marketization and agglomeration has been analyzed. The theoretical analysis shows two main results:firstly, intellectual property rights can increase the income of innovations locally, and then induce innovation clusters. Firms try to get together in order to enjoy knowledge externalities. Secondly, marketization can enhance the market access of commodity, and then improve firms’operating profit locally. According to the theoretical analysis results, this paper selects the statistical data of30provinces of China from1997to2009and then does regressions using the indexes based on the statistical data. The regressions results show the same situations as the theoretical analyses’.
