The migrant worker is a special group results from social transformation, urbanization, and modernization. The amount of migrant workers has been increasing these years in China, and they play a significant role in labor market and economic development.Most of the migrant workers are employed in manufacturing industry and construction industry where has high risk of being injured. The whole society and academicians put great high value on problems of migrant workers’social security especially injury insurance in construction industry.Being injured, migrant workers can be compensated by injury insurance, civil action and conferring with employer. Different manners lead to different results. Based on game theory, we can find the best way that can get the most compensate through dominance model and the current way migrate workers paid through amendatory model.As the primary input area of migrant workers, Guangzhou, Shanghai, Shenzhen, Beijing etc appeared rules and regulations first which are made for protecting migrant workers. One kind of these rules and regulations is to take migrate workers as city workers and another kind is to make specialized rules and regulations.There is a gap between the two models. By analyzing the factors which leads to gap arid drawing lessons from the primary input area, countermeasures will be approved aiming on finding out the best way to protect migrant workers.
