Study On Social Injury Insurance Of Migrant Workers In Construction Industries

With the deepening of the reform and opening up,migrant workers are increasingly becoming an important force in chinese national economy production. Construction industry is the most gathering industry that migrant workers are in,but also one of the three high-risk industries.Due to the restrictions in the work environment, construction industry practitioners suffered much more internal and external risks and hazard factors than workers in other industries. Although our country has promulgated the 《work injury insurance regulations》 in2004,but migrant workers has strong liquidity, and they are also the vulnerable groups of society, migrant workers’s work injury insurance has been a hot issue of society for many years. Study on work injury insurance of migrant workers in construction industry is particularly prominent. Therefore,carrying on research on work injury insurance of migrant workers in construction industry has significant meaning for protecting rights and interests of migrant workers and building a harmonious society.Basing on the theoretical analysis to the work injury social insurance of migrant workers in construction industry, using the decoration business in construction industry as example,analyzing a typical case of work injury for migrant workers in company A,the paper systematically analyze main problems and their causes of work injury for migrant workers in construction industry and then propose the solutions to work injury social insurance for migrant workers in construction industry.Research shows that there are there main problems for injury insurance of migrant workers in construction industry now:migrant workers are the group where accidents and occupational diseases happen at a high probability and also a major group that injury insurance leaked; the classification of rate for injury insurance is fuzzing and not clear enough; cumbersome procedures of claims and deficiencies of related institutions lead to the lack of procedural fairness and prolong of the claims time. Looking into the reason, it mainly include:the job is much harmless and their legal consciousness is very poor; procedure for confirm of the work injury and its process are very complex; regional differences lead to the balance of regional insurance rate; problems of legislation layer issues relate injury insurance system; confirm for work injury in practice has many contentious; treatment of work injury insurance is not perfect.The paper finally propose complete suggestions for work injury social insurance for migrant workers in construction industry:first,we should strengthen improving the institution construction of injury insurance of migrant workers; second, we need to build effective compensation mechanism; third, we should pay more efforts to work injury insurance; forth, we need to strengthen injury prevention and rehabilitation.
