The Protection Of Farmers’ Rights&Interests In The Land Ticket Transactions

Chongqing city as one of the rural comprehensive reform demonstration sites, its development takes the leading function for the whole country. In recent years, Chongqing city has made substantive results in urban and rural construction. With the accelerated process of urbanization in Chongqing, the problems encountered are also prominent, the increase of urban construction land use with the contradiction between the arable land cordon, which is particulary urgent. In order to resolve the tense situation of land use for urban construction land, Chongqing city established the rural land transactions on December4, in the year of2008, and proposed the concept of "the Land Ticket Transactions" for the first time in whole country.The nature of the Land Ticket Transactions is the land transfer, it is a new attempt. It says that the index of urban construction land use is related to the rural construction land use. The ticket-trading system’s idea is "reducing the arable land at first, using the urban construction index at the second ", it has greater efforts in protecting arable land, and has the better protection. The Land Ticket Transactions as the form of notes, makes an inventory of the farmers’"dead assets", achieves the physical trading virtualization, excavates farmers’property income effectively. In recent years, the economic develops rapidly, urban construction continues to intensify, urban land is in short supply. In constrast, the rural economy is at a low level, township economy is relatively backward, the rural land resources can’t be fully utilized. The opposite situation for both, the Land Ticket Transactions can make a good combination, combine the urban land market with the rural land market together, and promote the development of rural land market.After several years development, the Land Ticket Transactions trading system is maturing, but there still exist so many problems. In this paper, the integrated use of urban and rural survey data of the Chongqing Municipal Development and Reform Commission, Chongqing Rural Land Exchange data and the own visits of survey results, finding that actually problem exist in the Land Ticket Transactions. For example, the protection of farmers’rights and interests. In the trade of the Land Ticket Transactions, there have four categories of participating subjects, they are farmers, rural collective economic organizations, government departments, as well as the purchasers of the Land Ticket Transactions. Because the asymmetry of transaction status and transaction information, farmers’interests can’t be guaranteed, who are in the disadvantage status.This paper uses Bayesian Nash equilibrium analysis between farmers and governments, farmers and rural collective economic organizations, governments and the real estate developers. At the same time, we use the tree diagram between the economic game parties, draw to make a better explanation.It can be seen that the main body of the interests of all parties without any constraints limit will make the most rational choice to maximize their own interests by the game of every party. Because there is a divergence of the interests between the governments and farmers in protection of the farmers’rights and interests, at the same time, governments have their own rights and advantages, they are bound to make the actions detrimental to the interests of farmers. On the other hand, rural collective economic organizations on behalf of the village cadres orientation will be cooperate with farmers because of their own interests. So that, they can get the higher levels governments’honors. For the case of real estate developers, maximizing their own interests is always a fundamental goal of most demand. In the rapid development of urban construction, more land use rights will be necessary to get the profit. Therefore, the real estate developers hope to maximize the proportion of their profits in the deal with the governments.When parties stakeholders in the constraints have limited circumstances, local governments and village cadres as representative of the interests of farmers, often make sure their own interests before taking measures to protect the interests of farmers.At last, this paper put the following suggestions:firstly, enhance the status of the farmers in the transaction and the rights to speak and know. Secondly, improve the trading system, avoid the possibility of trading in the black-box operation. Finally, establish a sound social security system, eliminate the worries of landless farmers.
