Dealing with the issue of climate change caused by greenhouse gases has become amajor challenge for humanity. With global joint efforts, the “United Nations FrameworkConvention on Climate Change”(UNFCCC) has been adopted by the United NationsGeneral Assembly in1992aimed at controlling the climate. This convention built anoverall framework for reducing worldwide greenhouse gas emissions, and it is furtheradopted the “Kyoto Protocol” in1997which has clarified the obligations of reducinggreenhouse gas emissions for developed countries.There are not only the obligations for developed countries in The “Kyoto Protocol”,but also the introduction of the three mechanisms, which provide a market-basedinstrument to promote carbon reduction and the Clean Development Mechanism (CDM)is one of them. It is a project for the developed countries to Reduce their emissionreduction costs cooperating with the developing countries by outputting technique andfinance. As a developing country, China also has a very important role in theimplementation of the CDM. This mechanism is of great significance for our country.CDM related legal issues has been analyzed. The main body can be divided intofour parts, that is an overview of the CDM, CDM development prospects, China’sproblems in CDM practice and countermeasures.The first part is an overview of the CDM. Its background and relevant internationalconventions has been mainly introduced. Then it described the rules for the operation ofthe CDM, related eligibility for participation subjects involved as well as the operationprocedure of the CDM program.In the second part the author reviewed the development of CDM and outlooked itsfuture direction. The position and efforts made by our country in the internationalclimate issues has been analysed.The third section is briefly titled the main content of the “Operation andManagement of Clean Development Mechanism Projects”. The exposed problems in theCDM project has been discussed. There are also many existing problems in our legalsystem and in the implementation of the projec. It is necessary to improve the relevantregulations of the CDM.In the fourth part, the author raised corresponding answers to the problems relatedand proposed measures to improve the mechnism based on the status quo of China’s implementation of CDM.
