Legal Issues Of Environmental Risk Assessment

Risk precautionary principle is widely recognized in the international community, andabsorbed by the domestic law of many countries, environmental risk assessment system hasbeen established and developed in Europe and the United States, especially in theinternational environment for trade, environmental risk assessment become a nationalintegralpart of the trade decisions. At present, China’s environmental conditions worsening trend hasnot been fundamentally changed, continue to increase the pressure on the environment,continuously improve the environmental aspirations of the masses of the people, massincidents caused by the environmental risks, pollution incidents are increasing,risk preventionhas become a long-term, environmental Risk Assessment facing a grim situation. China’scurrent environmental impact assessment system has been unable to meet the requirements toprevent environmental risk, environmental risk assessment system should be established inorder to comply with the needs of the practice of environmental protection, and study thelegal issues involved in the environmental risk assessment. This paper focuses on this purpose,combination of two classic cases, analysis the lack of of the environmental risk assessment ofthe legal system in the law, the functions of the government, public participation, and putforward my own views on how to improve our environmental risk assessment legalsystem,hope to have some reference value of China’s environmental law theory research andenvironmental risk assessment practice.
