Study On The Legal Issues Of Ecological Environment Protection In Mining Areas

Shanxi is rich in coal resources, the development of coal economic has become a pillar industry in Shanxi Province. However, due to the weak of people’s awareness of environmental protection in the process of development and utilization of the resources, over-exploitation of resources led to a series of ecological and environmental problems, such as land destruction, soil erosion, atmospheric and environmental pollution, which not only make the air quality of Shanxi get worse in recent years, but also pose a threat to the health of the people of Shanxi. Ecological and environmental problems in mining areas, has become a major obstacle to build a harmonious and sustainable society, what’s more, protecting mine ecological environment is in extreme urgency.This paper starts from the present situation of mining areas’ecological environment, puts forward the significance of the protection of ecological environment to legislation construction and mining areas’people, and introduces the existing legal system of mining areas’environment protection, then analyses the shortcomings of the existing system in legislation respectively and identifies the problems needed to improve, meanwhile this paper also studies the advanced experience on legal protection to the mining areas’ecological environment aboard and the reference to our country. On the basis of the above, this article gives some specific suggestions on improving our countries legal protection to mining areas’ecological environment, which contains the improvement of legislations on mining areas’environment, such as improving legislative idea, legislation system and so on; It also contains strengthening mining areas’environmental law enforcement, such as making clear the administrative law enforcement subjects, strengthening the public participation during the law enforcement, the author wish it will play an active role in improving mining areas’ecological environment.
