Research On Legislation For The Recycling Of Waste Electrical And Electronic Equipment

Based on the concept of circular economy as the background, starting from the connotation and characteristics of waste electrical and electronic equipment,this paper analyzes the current situation of recycling, disposal and utilization of the waste electrical and electronic equipment in our country and puts forward the existing problems in the management and disposal of this equipment. And then this article leads to the concept of circular economy, taking the process "resources-production-consumption-circulation-recycling" in circular economy activities as the basis, discusses the relationship between the ecological design of electronic and electrical appliances, electronic and electrical energy consumption, cleaner production of electrical and electronic industry, the reusing and recycling of electronic and electrical equipment and circular economy. By moving the processing col of waste electrical and electronic equipment forward and researching the recycling of it is able to make the concept of circular economy through the legislation of electrical and electronic waste recycling and reusing.For the recovery, reusing and disposal of the waste electrical and electronic equipment, China has made laws, regulations and policies which can be divided into four levels:the first is The Circular Economy Promotion Law; the second is Cleaner production promotion law, Energy conservation law and Law on Prevention of Environmental Pollution Caused by Solid Waste; the third is The regulation of recycling and disposal of waste electrical and electronic products; the fourth is "management approaches" introduced by the competent authorities. There are many problems remaining in the laws, regulations and policies. For example, there remains a lack of unified legislative guidance and a vacancy of comprehensive legal; the current legal system is scattered while its operability and pertinence is not strong; the supporting standards of the legal system are inadequate, etc. Some successful foreign legislation experiences provides beneficial reference for us, such as the EU’s RoHs Directive. The EU’s development of electrical and electronic waste recycling process is:from the end of treatment to the source control, from the disposal of the waste electrical and electronic equipment processing to material recycling in each industry and then to the whole society’s benign circulation.To perfect the legislation for the recycling of waste electrical and electronic equipment, the author puts forward the basic principle of the legislation system and longitudinal and transverse perfection of this legislation including the addition about the development of the recycling of the waste electrical and electronic equipment in the constitution, the establishment and improvement of terms of the supporting laws, regulations, standard specifications and other contents. At the same time, the author discusses on the improvement of the key points in the legal system of China’s recycling of the waste electrical and electronic equipment in order to learn from foreign advanced experience combined with the actual situation in our country and to further improve the market access system of electrical and electronic equipment, the system of extended producer responsibility, system of economic incentive and so on.
