Study On Development Of Enterprise Legal Department Under The FIDIC Contract Environment

Conditions of Contract for Construction (hereinafter referred to as the "FIDIC" contract)published by the FIDIC (Fédération International des Ingénieurs-Conseils) has been recognizedand widely used in the world, in China’s influence is expanding. The domestic existingresearch mainly focuses on the analysis and application skills of FIDIC contract provisions,but there are few researches on how the legal affairs department of construction companiesand real estate development enterprises should be changed in order to adapt the FIDICenvironment.On the basis of research and analysis of the FIDIC contract characteristics, comparativeanalysis of FIDIC contract with the Ministry of construction1999edition "constructioncontract (model version)", this paper carries on the transformation to the Legal AffairsDepartment of construction companies and real estate development enterprise humanresources, organizational structure, transaction management in order to adapt to the FIDICcontract condition. The main contents and results include:This paper briefly introduces the basic situation of the FIDIC (International Federation ofConsulting Engineers) and the1999edition of "conditions of contract for construction"(Conditions of Contract), the case law system and the characteristics of the FIDIC contract,and focuses on the main core terms of the "conditions of contract for construction (Conditionsof contract for works of civil engineering construction)". This paper also analyzes the maindifference between the FIDIC conditions of contract and the Ministry of construction1999edition "construction contract (model version)". This paper analyzed the shortcomings oflegal affairs management of the domestic real estate development enterprises, and the impactand influence that FIDIC contract text brings to domestic engineering contract environmental.This paper discussed the legal affairs department internal construction and the internalrelations with other under the FIDIC contract conditions, has a certain novelty in this respect.It also analyzes the choice of enterprise legal service source problems.
