Legal translation forms an important part in external legal exchange. It is apowerful incentive for improving legal system. In addition, with the increase of thecases in which foreign elements are involves, legal translation has received muchattention.This report is based on the English–Chinese translation of the Mortgages inDivision3of Property Law Act1958. Victoria, Australia. The unique Australia legalsystem increases our exposure to ideas and methods that will improve ours. As themortgage mechanism forms an essential part in complete socialist market economicsystem, the author translated the legislation on mortgages.The report analyses and explores the translation strategies for legal term andcommon sentence patterns including long sentence, relative clause, passive sentenceand parallel structure. For legal terms three strategies are adopted, namely literaltranslation for terms with same or similar conceptual meaning, interpretive translationand literal translation; the aim is to reproduce the meaning of term as precisely aspossible. The main strategy for long sentences is deconstruction and reconstruction.For relative clause, the preposed approach and simplified approach on the basis oflogical analysis are adopted. Passive sentences are mainly translated into activesentences, sentences without subject,“…… de” sentences. The strategy for parallelsentences is translating according to the subordination relationship of differentelements. All the above strategies render the target text conforming to the legalChinese standard and more readable.The report also analyses and explores the basic principles of legal translation.Accuracy is should be the most important principle; on this basis, the legal translationshould also abide by the principles of standardization and concise. Forensic languageis highly professional, with many legal terms, therefore, principles of identity andlegalization should be followed.
