Faced with theinternational trend of working hours flexible, this paper attempts tocombine the special circumstances in China, to explore the road of China’sworking hours flexible.The main contents are as follows:The introduction part focuses on the two hot social events–“death fromoverworkâ€and “Foxconn pay riseâ€, the two cases reflect the two differentattitudes of workers, and thus leads to our current system of working timetoo rigid and unable to adapt to the needs of the community.The first chapter focuses on the concept of working time. There are twomainstream way to define working time. The one is defined according tothe law, the other one is defined according to whether the employee subjectto the employer.The second chapter focuses on China’s current system of working time,contains the standard working time, special working time. The articlestates three main problems of our country’s working time system. First is that the working time system is too rigid. Second is the low level ofcollective negotiation system. Third is the too weak power of laborsupervision.The third part of this article is mainly introduce the flexible workingtime system of Japan and Germany.The fourth chapter focuses on our country special national conditions,combined with foreign flexible working time System experiencerespectively, from the macro labor standards, the concept of collectivenegotiation, and the micro-labor contracts to envisaged for the reformof China’s working time flexibility. |
