A new round of nuclear power development boom has risen across the world. However, the utilization of nuclear power is exposed to a high risk,and nuclear accident stands as a typical case. Proper emergency measures for the nuclear accident can notably reduce the radiation damage, both to the environment and the health of human being. The first part of this paper aims to,through examining the laws and regulations concerting the nuclear accident emergency from the international perspective, demonstrate the problems in current international laws and regulations in this area, such as a) non-integrated system, b) short of specific and concrete countermeasures, and c) insufficient provisions on international rescue. The second part of this paper, after comparing the laws and regulations in China and other countries,will point out several problems in China’s laws and regulations, such as a) absence of Atomic Energy Law, b) low level of legal effect,and c) discordant administration.Finally, some countermeasures and recommendations will be made to China’s laws and regulations, such as a) participation in the international legislations on nuclear power, b) formulation and enforcement of the Atomic Energy Law, and c) improvement of the related administration and supervision system. |
