A Study On Government Regulation Mechanism Of Industry Association

As an intermediate organization for the trade, industry association is an inevitableoutcome of market-oriented economy, which is playing an important role in theeconomic development and social management. Industry association is the third kind ofcontrol mechanism after the market regulation and government control, and it is calledthe second government abroad. In economic management, industry association evenplays a bigger role than the government, especially in the country or area where themarket economic system is especially well. Under the background of economicglobalization and China’s accession to the WTO, the economic system is strengtheningand innovating constantly, government transfers the functions continually and publicmanagement is become more diverse and social, all of which make the industryassociation develop quickly in China, and play a huge role in economic growth andsocial life.However, some industry associations have been appeared noncontrol phenomenaduring development because of the imperfect development of the industry association atthe moment, which goes against development of market economy and does harm tosocial benefits. The country is set up to manage the social affairs, thus the government isliable to supervise and manage the industry association.This thesis surveys the social dilemma that industry association in China lacksself-regulation, studies the other reasons that impacts the development of the industryassociation, and points out that the government should supervise and regulate theindustry association to guarantee the normal development of them.First, the thesis studies the current governmental supervisory mechanism in Chinain terms of review mechanism, access mechanism, the mechanism of competition,information disclosure mechanism, taxation mechanisms, reward and punishmentmechanism; analyzes the relationship between the industry association and governmentregulation by taking the National Organization of Dental Disease Prevention as anexample; on the basis of above all, summarize the dilemma of the governmentregulation including both excessive and missing constraints, lower external constriants,the structural defects of the legal and the existing of the dilemma on the governmentalindustry association; and then examines the causes of the dilemma at root, includesunreasonable management system, the imperfection of the laws and regulations, beingsubjected to the principle, and the neglect of the use of embedded regulation.On the basis of analyzing the government regulatory limbo, the thesis puts forwardthe suggestions of building the embedded governmental supervisory mechanism; set upthe model of embedded regulation; analyzes the motive power of the foundation of themechanism, which includes government, social, the industry association itself; andstudies the feasibility of the regulation mechanism, on the basis of the analysis of regulation wish and regulation ability, to explain the objectivity and the explanatorypower of embedded regulation. In the end, the last chapter raises to build the system ofsupervisory mechanism by system construct, divesting management means, improvingthe relationship with the industry association.
