The Research Of Roadside-Parking Legal System

In China, the vehicle numbers continue to rapidly increase, but the growth of theparking lot is relatively slow. In this background, the roadside-parking is widespread. Itis roadside-parking that use the bicycle lanes in public road to draw stop line, mark thecharge standard and charge. Due to the lack of unified legal norms, there are manyproblems. In this paper, we studied the properties of., teased out the legal loophole ofthe roadside-parking, pointed out the legislative suggestions of the roadside-parkingbased on referring to existing legal provisions and foreign management scheme.This paper is divided into four parts, which is based on the social practicalproblems, and the purpose of which is put forward legislative proposals.In the first part, we analyzed the current problems faced and the research statusdomestic and aboard. Roadside-parking is facing many problems such as imbalance ofthe supply and demand, overcharging, lots of illegal roadside-parking and so on. It is theprincipal causes of this problems that the imperfect legal system and management of ourcountry. So it is very necessary that bring the road-parking into the perspective of law.In the second part, we mainly analyzed the properties of the roadside-parking. For thissocial phenomenon, we analyzed in two angles of economics and law. From theperspective of the economics, the roadside-parking belongs to quasi-public good, whichshould be managed by the government or qualification enterprises. From theperspective of law, we think that it is a concessionary administrative legal relationshipbetween government and enterprise, and it is a safekeeping contract legal relationshipbetween enterprise and the car owner. We also think that the bicycle road user’s right isignored by the government. The third part mainly analyzed the legal problems ofroadside-parking. Since there is no unified complete law, subject of parking line and itsprocedure is unknown, and the price formulation is lacks of legal basis. The fourth partis the emphasis of the article. Based on the the existing regulations and foreignexperience, it is respectively put forward that administrative measures ofroadside-parking, administrative measures of roadside-parking fee and administrativemeasures of construction of parking spaces by us.China is a socialist country ruled by law. Various branches of law, continuousdevelopment and improvement in practice Law-making should be based on issues ofsocial life, as reflected in the constant additions and modifications.So,horizon in the parking problem, we hope this thesis can give enough attention to the relevantdepartments, making the road-parking behavior into law adjustment range.
