| Not only is construction of Free Trade Area among China-Japan-Korea in accordwith long-term interest of economic development, but also provides most of impetus forEast Asian integration. Construction of China-Japan-Korea Free Trade Area meansChina-Japan-Korea Free Trade Agreement（short for ‘FTA’）is signed, which will makeinstitutional arrangements on goods and services and investment and so on. It will referto many legal issues such as principles and legal basis of negotiations, and rules-making.Therefore, considering the launch of FTA negotiations among China-Japan-Korea, it isnecessary to study on legal basis, and principles of construction to abide by, and mainlegal issues of contents of negotiations.There are four parts in this thesis.Beginning with the necessity of construction of Free Trade Area amongChina-Japan-Korea, the first part emphasizes legal basis of FTA negotiations amongChina-Japan-Korea, from WTO multilateral trading system and trading legal systembetween and among China and Japan and Korea, and domestic legal system respectively,and then points that it set an example that regional trading agreements and bilateraltrading agreements concluded by China and Japan and Korea.The second part analyzes principles to comply with during construction ofChina-Japan-Korea FTA, and probes into main contents FTA of negotiations amongChina-Japan-Korea combined with suggestions by Joint Study Report for an FTAamong China, Japan and Korea.The third part discusses the difficult issues during FTA negotiations amongChina-Japan-Korea, coordination with existing institutions, and agricultural marketaccess of goods trading liberation, and services trading and investment facilitationconcluded.Based on analysis above, the fourth part provides suggestions for routes to establishChina-Japan-Korea FTA, and sets out legal strategies on preparation for negotiations,and principles of construction and contents and tactics of negotiations from theperspective of China. |
