A Study On Legal Mechanisms Concerning Financial Supervision Of China-ASEAN Free Trade Area

The1997Asian financial exposed the drawback of lacking cooperation in financialsupervision of East Asian economies, and at the end of2007the outbreak of U.S. sub-loancrisis has made East Asian countries and china realize the importance of strengtheningfinancial supervision cooperation. With the building of China-ASEAN Free Trade Area in2010, the financial cooperation is going deeper. However, financial supervision cooperation inChina-ASEAN Free Trade Area has just started, the legal mechanisms framework whichformed in financial supervision cooperation has no signal. Therefore, studying the financialsupervision cooperation in China-ASEAN Free Trade Area has a certain theoretical andpractical significance. On the basis of studying the existing situation of financial supervisioncooperation, this paper analyzed its shortcomings, analyzed and the rules of EU、WTO andBCSC about financial supervision cooperation, and then put forward my own immature frameconception and suggestion about perfect law.In addition to the introduction, the body of this article consists of five parts.The first part: about the theoretical analyzes of financial supervision cooperation inChina-ASEAN Free Trade Area, the necessity and feasibility to illustration the importance offinancial supervision cooperation in China-ASEAN Free Trade Area.The second part: about analysis the regulatory situation of financial supervision inChina-ASEAN Free Trade Area from the banking、securities、insurance industry aspects,andpoint out the current existing problems.The third part: about international comparison and reference. Through the analysis andevaluation of EU、WTO and BCBS on the financial supervision regulatory, provide referencesfor China-ASEAN Free Trade Area to establish reasonable and effective financial supervisionmechanism.The fourth part: about model construction of financial supervision cooperation inChina-ASEAN Free Trade Area. this part illustrate from the pattern choice、legal basis andsupervision contents and other aspects of the construction.The fifth part: according to the draws of financial supervision cooperation inChina-ASEAN Free Trade Area, the author bring out some measures: one is to strengthen theexisting bilateral regulatory cooperation; two is the development of an effective regulatory cooperation mechanism; three is to establish a unified financial regulatory standards; four isinnovate regulatory cooperation.
