The prepared food business activities with characteristics of Site making and selling havealways been the high incidence of China’s food safety and the weak area insupervision.Because the Current Segmentation regulation-based supervision model issupplemented by the supervision of different varieties, it can not achieve the very objective ofseamless food regulatory. The prepared food business activities with characteristics of Sitemaking and selling combine the nature of processing and circulation is difficult to find theexact regulatory body in the current supervision model, which led to the intensifying securityproblems, resulting in the regulatory difficulties of the prepared food.The regulationpredicament of The prepared food business activities characteristics of Site making andselling is just a microcosm of the loopholes of China’s food safety supervision model. Thereseach object of this paper is the prepared food business activities that characteristics of Sitemaking and selling as the research object. Through case studies to explore solution paths tobreakthrough the supervision predicament, at the same time this paper is to discuss how toimprove and optimize our current food safety supervision model in order to achieve seamlessregulatory and reference recommendations.Except the preface and conclusion, the paper is composed of five parts.Part one, the safety regulatory predicament of prepared food. This part analysised thethree dilemmas of prepared food safety supervision:One is the deficiencies and defects of theexisting laws and regulations; the second is controversion of the supervision right of preparedfood safety regulation; the third is ineffections and omissions during the execution of thecurrent supervisory power.Part two, reasons about the predicament of the prepared food safety supervision. Thispart analyzed the reasons of the formation of the prepared food safety supervisionpredicament from three different perspectives of the main market players, the AdminstrativeSupervisor and Social Supervisor,that the formation of regulatory predicament stems from:Market players with the nature of "economic man" lack of effective incentives for processing and selling in line with the prepared food safety and quality standards; because existing lawsand regulations do not have a clear regulatory authority to configure the requirements, theadministrative supervisors with the nature of "bounded rationality" always shiftresponsibilities onto other regulators; social supervisors are in a weak assisted regulatory.Part three, researches on the necessity for particularly security governance on theprepared food. This part analzise the necessity of breaking the supervision predicament ofprepared food and the importance of making clear the right regulator of prepared food,emphasized that research is extremely necessary to the supervision issues on prepared foodbusiness activities characteristics of Site making and selling whether point of view from theperspective of the cases settled regulatory predicament, or send to improve our supervisionmodel in order to better achieve seamless supervision.Part fore,Comparison and Reference is comparison and reference on the major foreignfood safety supervision model. In this part through a critical analysis of the foreign main threefood supervision model, This part analyzed three main forergn food supervision models andsummed up the follow development trends of the food supervision model to provide areference to improve our regulatory system:First, the development trend of the whole processof supervision "from farm to fork"; Second, the regulatory authority from separation toconcentration development trends; Third, development trend as the separation of riskassessment and risk management.Part five, research researches how to solve the safety supervision predicaments ofprepared food..In order to solve the supervision predicament, this part puts two paths, andmakes a discussion on which path is better. With path selection, combine under the currentlegal system with practice and experience, the paper obtained the conclusions that thesupervisory power of the prepared food should belong to the business sector. Finally, thepaper reflect on how to improve China’s food regulatory system to better achieve seamlesssupervision,the main point of views as follow: in the medium term, under the premise of theexisting supervision model, the regulatory authority should make some change to meet thesafety supervision needs; in the long-term point of view, inorder to improve and optimize food supervision model, our food supervision model should comply with the supervision model ofthe overall trend towards the "from farm to fork" the whole process of supervision as well asthe direction of regulatory permissions from separation to focus, etc.
