In December2009, China promulgated the suggestions called《The State CouncilAbout Speeding Up The Development of Tourism》.this suggestion will determine thetourism industry to develop of the national economy and people’s strategic mainstayindustry which is better satisfied of modern service industry. The Chinese tourismindustry will go into a new stage of development. At present, in China, the travelmarket’s disordered degree is concerned, and it will be the inevitable obstacles on thedevelopment of China’s tourism industry if let it go on developing like this. To this,for such a relationship to the public interests of the special market, we need to alsoshould study it from the legal Angle. It should be regulated by the laws, and topromote the healthy development of it. This paper will study the problem of theregulation of the law of the travel agency.In addition to the full text structure arrangement with the introduction, the texthas four parts.The first part is " the theory of legal regulation of China travel service market ".This part of the first from the basic theories of travel agency, it tells the story of thedefinition and characters of travel agency. Second combined with "regulation","themarket","market failure","government failure" and so on the concrete connotation ofthe concept of market regulation, the paper defines, and points out that the marketregulation of the development of the market value of place, to market regulation andpoints out that the most effective means-legal regulating. The author thinks that, themarket economy has its own defects, so the development of the market economy willnot development without the government’s regulation. And the government also canappear failure condition in market regulating process, this needs to be a set of superiorto the above rules of both to the market and the government’s "double failure" inregulation, and that a set of rules can only is the rule of law.The second part is "China travel service opportunities and legal dilemma", thispart of the first points out that China travel service market in the new situationopportunity of development, and the travel market in China are analyzed, in view ofChina’s travel agencies such as the market order of the existing market chaos, marketcompetition degradation, analysis the root of the problem is, as the perfect measuresbelow lay the foundation. The author thinks that, only found that China travel service market, the main problems of the present situation of our country and combining tothese problems analysis of the causes, can put forward further beneficial to Chinatravel agency of the development of the market perfect measures and countermeasures.The third part is the "travel market regulation of international comparison", thispart of the United States, Japan’s main travel market status of legal regulations of ourcountry market introduction, as well as the enlightenment of the legal regulation travelagency.
