China is particularly rich in tourism resources, and has a huge potential for development in tourism market economy.Since the21st century, China’s tourism industry has entered an unprecedented stage of rapid development. As the leading enterprises in the tourism sector, travel agency plays an indispensable role in the prosperity and development of China’s tourism industry. However, with the continuous development and growth of the travel industry, the number of travel agencies increased significantly, in order to compete for customers and their own development,many travel agencies take a series of obvious acts of unfair competition, and these behavior has become increasingly fierce.This not only infringes upon the legitimate rights and interests of other travel agencies and tourists, but also broken the extremely fragile tourism market competition order, so the development of the tourism industry has seriously deviated from the benign track. Although China has enacted a variety of laws and regulations,all levels of local tourism administrative department also continue to strengthen efforts to crack down on unfair competition for travel agents, but the actual effect is not satisfactory.Therefore, in-depth analysis of the causes of the travel agent acts of unfair competition, and has far-reaching theoretical significance and practical role to regulate the travel agency business behavior and the healthy development of the tourism industry.So far, the acts of unfair competition against travel agencies, mostly from the point of view of economics and tourism management commenced, and from a legal perspective, particularly from competition law system is relatively small. In this paper, based on the analysis of acts of unfair competition of all types of travel agencies, as well as its root causes and proposed should be changed the current tourism unreasonable policy regime, as well as to achieve further improvement of legislation and strengthen the supervision of the travel agency business behavior be the purpose of the comprehensive competition Law. This paper is divided into five parts, including Introduction:The first part is introductionThis section through an overview of the tourism industry, pointed out the importance of orderly competition in the tourism market for the development of China’s tourism industry, and also pointed out that the existing travel agency grim situation of unfair competition, and on this basis, the existing research combing and evaluation, to find the starting point of this study.The second part is the present situation of unfair competition in ChinaThis section illustrates several typical manifestation of unfair competition, analysis of the impact of unfair competition on the travel agency industry and tourists interest, as well as harm to the development of China’s tourism industry, the present situation must be changed.The third part is the reason of unfair competition in the travel agencyTo undertake the second part, in view of the existing problems of travel agency competition, through the observation of internal mechanism and external operation of travel agency, a comparative analysis of the difference between China and the developed countries in tourism travel agency regulation law, and points out the shortcomings of the existing laws and regulations in China; at the same time, deep into the analysis of problems in China’s current tourism system, laid the foundation for the solution of the problem.The fourth part is way to solve the unfair competition of travel agencyComprehensive analysis of the causes of unfair competition in the travel agency, put forward the solution:in the legal level, expand the coverage of the relevant laws and regulations, to solve the existing legal illogic and lagging; and in the policy level, improve the tour guide security mode, increase tourism information transparency and not as a status change industry association, to stop the spread of unfair competition potentialThe fifth part is the conclusionOn the basis of the fourth part, summarize the unfair competition of travel agencies solutions, that only use a multi-pronged governance to comprehensive policies and the legal guarantee of the healthy development of China’s tourism industry.
