The Legal Counterplan Of International Goods Trade During Post-Crisis Era

On September27,2010, The International Chamber of Commerce (ICC) formally launched the Incoterms2010. It went into effect on January1,2011. Since the first edition published in1923, international trade terms have been used nearly ninety years. With the great changes of international trade, the modification of Incoterms is also great. Incoterms has played an irreplaceable role in promoting international trade development and international economic integration. During the post-crisis era, international economic situation is facing the haze. Also, foreign trade field in our country now is an important economic growth point. It is necessary to study new international tendency reflected by international trade terms, and to make corresponding foreign trade strategy and countermeasures considering the international economic environment.This paper intends to start with the revision of international trade terms to summarize the vertical trend of the development of international trade and to use the post-crisis era economic environment as the horizontal axis so as to analyze the current economic situation trend and international trade status which our country’s international trade of goods faces. And then the countermeasures under the new situation of international goods trade are put forward.The article is divided into two main lines. The main one focuses on the international trade terms changes. This part is mainly about the background knowledge of international trade terms, such as the origin, the summary of using and textual situation; In addition, the comparison of the specific changes separately in Incoterms2000and Incoterms2010will be made. In the light of this, the trends of Incoterms’ modification during the last20years will be analyzed.The paper also makes the analysis about the post-crisis era international economic environment as the vice line. The current economic situation is called the post-crisis era which is a period when crisis is soothed, and the situation is relatively quiet. But because the inherent crisis hasn’t completely been eliminated, the overall economic environment is still full of uncertainty and instability. It lasts from the end of2008, the U.S. subprime crisis to the current economic crisis spreading from Europe debt crisis. During this period, many subtle changes came up in the world economic field, and the trend presented is also totally different. On economic sensitivity high international trade field which is susceptible to economy naturally is difficult to get rid of the involvement. Through the performance of each important world economic entity there will be some analyses-about the current trend in the area of international trade to forecast the development of international trade change.Through the discussion of two clues, the author makes clear the international situation and at the same time, this article makes a corresponding research into China’s international trade in the specific situation. For a long time, our country has been supported by international trade income as an important economic growth point.The dependence on foreign trade is high, the added value of products is low, and the trade friction is serious. In the international goods trade, the world’s leading economies are growing weakly, and their demand on the foreign trade is being reduced, and the prospect of economic development is unclear. The trade protectionism is a foreign trade problem urgently needed to be deal with by our country. In addition to the macro research of our country’ foreign trade strategy, the key of this article is to put forward the legal corresponding countermeasures to solve the increasing trade conflict.In conclusion, on the basis of the evolution and the latest revision of international trade terms, this paper combines the analysis of international economic environment, and raises some practical and effective suggestions. The innovations in this thesis are as follows:firstly, some forms are used to make a direct comparison. Secondly, with the economic background of emerging international economic events, the revision of Incoterms2010serves as the breakthrough point, which is specific and practical.
