There have been more and more cases of sexual harassment in workplace, which bring damage and hardness to the employees. As the law system is tend to be better and perfect than before, a lot of right of citizens has been protected by their respective special law. However, sexual harassment in workplace, the serious social problem, does not have a set of special law or a special law item to regulate it. There are some analyses on sexual harassment in workplace, but they are almost analyze from the point of view of civil law. However this essay holds the point that sexual harassment in workplace damages not only the civil right but also the right to work. This essay aims to research how to regulate sexual harassment in workplace in the labour laws. This assay includes three main parts.The first one pays attention to the theoretical analysis on regulating sexual harassment in workplace by labour laws. Connected with the outstanding points in the world, this essay defines the meaning sexual harassment in workplace, summarizes the constituents. From the view of right to work, the essay analyze the damages of sexual harassment in workplace. This is the theoretic base of regulating sexual harassment in workplace by labour laws. At the last of this part, the essay on one hand point the damages to the employee, employer and the whole society, on the other hand the expounds the necessity of regulating sexual harassment in workplace by labour laws. The second part enumerates and researches the laws of American, the UK and Taiwan, which three are very successful in regulating sexual harassment in workplace. The research focuses on the respect of labour laws, the protect of right to work and the relief of right. And then find out the points which is worth of adopting.The third one gives advices in details which conform to the practice of China and can be enforced in practice on the base of the aforesaid. These advices can be generalized to three points:put the issue of regulating sexual harassment in workplace into labour laws; acknowledge that the employers are reliable for sexual harassment in workplace; establish the relief system for sexual harassment in workplace in the field of labour laws.
