Trade unions represent and defend the worker’s right. The development of the trade unions relate to masses of worker’s right and construction of the harmonious labor relationship. In this paper, at this stage of the private sector unions as the research object. I used the Marxist theory of trade unions to guide this paper. I used theoretical and empirical research methods in this paper. I analyzed the private sector trade union at this stage more comprehensive and deeper from four aspects.The first chapter is an overview of the theory of the trade union, including the related concepts of trade unions and trade union in safeguarding worker’s rights. The first part of this chapter defined unions, analyzed the provisions about the nature and status of trade unions in domestic and international law. The second part of the chapter discussed the theories of the trade union, including the Western capitalism union theory and Marxist trade union theory. This chapter set forth the theory of the trade unions, in order to provide the necessary theoretical support for the analyzing of the development of Chinese private sector trade union situation and reason. The second chapter elaborated the present stage of the development of private sector union situation. In the first part of the chapter, I defined the private sector. In the second part of the chapter, I analyzed the development of Chinese private sector at the present stage. In the third part of the chapter, I elaborated China’s Trade Union Law about the private sector in safeguarding worker’s rights. The second chapter analyzed the problem about low trade union formation in private sector at this present stage through data. In he third chapter, I analyzed the problems and reasons about Chinese private sector in protecting worker’s rights. In the first part of the chapter, I analyzed the rate of the union formation in private sector behind the development speed of the private enterprise through data analysis methods. In the second part of the chapter, I analyzed the reason of the ability lacking about protecting worker’s rights in private sector, from the private sector trade union rights mechanism, the independence of trade unions, trade union cadres quality and low comprehensive. The fourth chapter is the problem and the reasons for China’s private sector trade union in the corresponding countermeasures. The chapter on two fronts, first to increase the publicity of the private owner, trade unions focus on large and medium-sized private enterprises, innovation CEPD mode, increase publicity and education of workers and of trade unions in low the importance of the measures of the government on trade unions. In the second part of the chapter, against the low ability in protecting worker’s rights, I measured that we should provide the protection mechanism about the Trade Union Law, spread the system of the direct election of the chairman of the labor union, promote equality negotiate collective contract system, reform the union cadres wage system and personnel appointment, strengthen to build labor dispute mediation mechanism and establish trade union rights safeguards mechanism measures.
