On Legal Liability System Of Food Safety

Food safety is one of topics about which closely related to human survival,which has relationship with every person’s life health and immediate interests and conducts the social order long-term stability. In recent years, there were frequently happened quiet a large scale incidents about food safety in our country, and it is fortunate that the emergency situations just have been suppressed in a sense because of the "Food Safety Law" come on stage peremptorily.And The handcore of each legal system is the legal responsibility design, In this paper, study from legal responsibility of all parts in the food safety field, it would be made some effort to build a more efficiencive food safety law system.The paper is divided into four sections to illustrate the law responsiblity about food safety.The first part introduces about the evolution in Food safety institution(system),and makes a breif summary about the development of food safety institution from ancient to modern, international to domestic.In part two, it was arranged general legal responsibility in proper order in food safety law which divided by legal relation nature, and which includes the civil and criminal legal responsibility.The third part is the hardcore of the paper, this part mainly researched on the administrative subject’s administrative functions in food safety institution and that produces the administrative responsibility. The important of food safety guarantee is supervision(regulatory),so this chapter focuses on building a much better and more effective Food safety regulatory system by theoretical research. and administrative relative person assumed administrative.In the last chapter, studied on some of special Implementation mechanisms in the food safety field. It mainly has punitive compensation system, government control system, the third part supporting mechanism, which in order to achieve diversification in the Implementation of food safety legal responsibility.
