This text tries to mark out the full landscape of delimiting issues in the East China Sea from the view of international law. On the basis of recognizing the foundation of this problem’s rising, the writer points out the substance of this matter is the sharp show of the structural dilemma on the problem of delimiting waters. The most critical parts of it are the sovereignty controversy of Diaoyu Islands and the delimiting analysis of the East China Sea’s continental shelf. This text is systematically carding the cause of sovereignty disputes in Diaoyu Islands and its possible effects to the delimiting issues in the East China Sea, arguing the undoubted sovereignty basis on which our country possesses Diaoyu Islands. According to the comparison of the arguments from both China and Japan, the writer points out both the jurisprudence of our country’s related claims and the irrationality of the Japanese ones. Finally, this text discusses deeply about some possible methods of resolving this issue, while considering the pros and cons from both political path and the legal ones respectively. The writer firmly believes that the delimiting issues between China and Japan in the East China Sea should rise to the height of our national strategy. Its final approach is determined basically to the powers of our country and the enhanced confidence of using these powers to protect our national interests. China needs to make use of legal actions maturely in order to create the more applicable international rules of law in the future’s negotiations of delimiting the East China Sea waters, guaranteeing that this matter would finally resolve successfully with it.
