Legal System Of Public Participation In Price Hearing

The price hearing system is an important part of the administrative hearing system of our country,which has important supervision and promotion function for the formation and adjustment of the price of utilities.The main form of price hearing practice in China is price hearing,which is the expression of hearing system in price decision.Public participation is an important way to ensure that price hearings are effective.On the one hand,the public has a say.The public can better exercise the right to know,participation,supervision and the right to know,and promote the protection of the interests of the public.On the other hand,it also promotes the decision makers’consideration of the factors that influence decision-making,increasing the scientific and democratic decision-making.However,it backfired.The implementation of price hearing system did not achieve the desired effect,and many problems were exposed in practice.The public participation initiative has been affected,and the public’s questioning of the price hearing system has been heard.And revolves around the problem:how to guarantee the exercise of the rights,how to arouse the enthusiasm of the public participation in price hearings,are problems we face at present and to be solved urgently.In addition,China’s price hearing system started late and the system was not perfect enough to form an effective public participation mechanism.The public and public representatives who participate in the price hearing often lack the participation and participation ability,and make it difficult to guarantee the effect of public participation in price hearings.This paper is divided into four parts.The First to clear the contents of public participation and price hearing definitions,at the same time,according to the characteristics of the public participation mechanism and perfect the legal system of public participation in price hearings in practice significance,etc.Second,in the perspective of practical cases in our country,with typical cases as the foothold,and then analysis and listed the problems of public participation in price hearing system,to further explore the deficiency of this system in our country.The third part,from the aspects of theory and practice to ensure the effectiveness of public participation,scientific and rational analysis,the focus from price hearing participation main body,operating norms,the supervision of the public participation,and security problems of the impact of current price hearing public participation mechanism are expounded.On this basis,the perfect legal system of price hearing of our country,to solve the problems of current price hearing public participation mechanism,perfecting the democratic consultation to participate in the decision-making process and advise price hearing system of public affairs,etc.In the fourth part,the author briefly summarizes and prospected the development of the public participation price hearing system in China.It is hoped that the legal research in this field is a little bit thin.
