The island is an important part of the territory of a State, the future of the worldis the ocean rights era, the world is more and more emphasising on the protection ofthe rights of national marine. Legal protection as a core of marine rights, the island isnot only the marine rights of a country to expand and develop the relationship,butalso is relatived to the economic development, political and military security. Theisland legal protection of China started later than in other countries, the legal systemis not systematic and complete, weak protection awareness of the people of the island.Since2010, China has promulgated the <Island protection law of the People’sRepublic of China>, and <National island conservation planning>, but on the Chineseisland of legal protection, there are still many problems.China is not only is with more than7,000islands, is also the largest populationbase. The island is an important part of China on the future economic developmentcan not be ignored, a sound legal system to protect, is conducive to China’s islandprotection and efficient, orderly development and use. Therefore, China shouldimprove the legal protection of the island as soon as possible to gain a foothold in thelegislation and law enforcement practice, learn from other countries on the basis ofChina’s basic national conditions, to build a system of island system of legalprotection.The legal protection of the island related to the future economic development ofChina, but also relatived the homeland security.
