The Legal Protection Of Network Individual Information Right

With the advent of the information age, the network has brought us convenience,but also has brought a lot of problems to network users, and these include personalinformation infringement. While personal information through the network withcollection and use, there is the network of personal information infringement. Becausewe not yet have legislation on the protection of personal information, couple with thebehavior of infringement network right of personal information is to flourish, and theway of that is to change, so the protection becomes very difficult. The networkpersonal information rights legislation should be a priority. Therefore, not only theconcept of personal information, network personal information such as the right needsto be determined is needed according to the actual situation in China, combined withforeign legislative experience, starting from the theoretical and practical, to ensure therealization of the legal protection of the network of personal information.This paper is divided into four parts to explore the network of legal protection ofthe right to personal information from a civil law perspective. The first part ofpersonal information through conceptual analysis qualitative analysis to define thenetwork of personal information rights, the same time that the network containingpersonal information rights control over network personal information, networkpersonal information to know, network personal information request the right toremuneration, network personal information correct, the right to delete four rights,network personal information control over is one of the core rights; second partthrough a comparative study to analyze the legislation and the protection of foreignmodels, pointing out the advantages and disadvantages, as our personal informationlearn of the civil law legislation; pointed out that the legal status and lack of China forthe protection of personal information in the network, and pointed out that thediversification of our network diversification of the main and infringement ofpersonal information infringement; final part of our network personal value analysisto study the value orientation of the right to information legislation, clearly related tothe main rights and obligations, and finally by the legal remedies and monitoringmechanisms to ensure the effective implementation of the law.
