Research On Highway Overloading Transportation Problem

Due to the overloading the serious damage to the road surface and the bridge facilities, resulting in a huge loss of state transportation fees, resulting in vicious spiral of competition of transportation market, easily lead to road traffic accidents, endangering people’s lives and property safety, leading to deformity of the development of automobile industry, approved by the State Council, from June20,2004onwards, in the national scope, focus management of the overload vehicles. Over the past9years, the overloading is banned repeatedly more than, have little effect, this shows that China’s relevant laws and the administrative management system is incomplete, there are also many problems, coordination defects, systematic difference between government departments, did not form a constraint of effective supervision mechanism, influence law enforcement, law enforcement personnel performance, fair law enforcement.Guangdong Province as one part of the traffic in our country traffic comprehensive administrative law enforcement pilot, and transportation management overload traffic comprehensive administrative law enforcement is difficult, as a case study, has the vital significance to the traffic law enforcement reform throughout the country.In this paper, the theory of public policy, public administration ethics and administrative law, according to the present situation of overloading transportation management, combing the present existing highway traffic administrative law enforcement problems, to discuss from the economic, institutional, legal and other aspects, the deep-seated reasons careful analysis on the effect of governance, governance overloading transportation related legal interpretation regulations of the spirit, try to put forward the reform of the administrative system, and combined with the actual traffic law enforcement work, put forward to formulate and improve relevant supporting which regulation, the formation of long-term mechanism, so as to further promote the development of traffic administration work, improve public transport services and the level of law enforcement.
