Study On The Informatization Of Anti-Corruption

At present, crimes of embezzlement and bribery have shown a trend of intelligence, science and technology, concealment, gangs. Crime consciousness and counter measures against the investigation is upgrading. Investigation against corruption and bribery faces more interferences and difficulties. As far as whether we can effectively solve crimes of corruption and bribery, corruption investigation mode should be transformed from passive to active. The revised provisions of Criminal Procedure Law has ruled that nobody can force the suspect to testify against himself, illegal evidence should be excluded According to the law, the lawyers in the investigation stage can be a active lawyer who can take part in the suit, not be monitored during the meeting. This will further increase the aggressiveness of the anti-corruption investigation, promote anti-corruption investigative mode towards the "active" direction. Science and technology is the first investigation force. To carry out the corruption and bribery investigation, needs more support of modern science and technology urgently than ever. And the key to improve the anti-corruption investigative capacity and efficiency is to strengthen anti-corruption construction of investigation informationization.Based on reflection of present situation of the anti-corruption investigation mode, the author put forward that the transformation of the indispensable, the direction of information, and the personal thinking on the informationization of how to build on anti-corruption investigation.This paper is divided into three parts.In the first part, the status quo of China’s anti-corruption investigation model of reflection is discussed. The current anti-corruption investigation mainly goes "from confession to card", the traditional mode. However, the new criminal procedure law further guarantees human rights and law enforcement, this investigative mode of anti-corruption is facing difficulties. The dilemma is shown as follow, difficult to adapt to the anti corruption work situation in the new era, difficult to adapt to the reform of the judicial system and mechanism, difficult to meet the need of the development of the rule of law, difficult to adapt to the demand of strengthening the protection of human rights.The first part also talks about the amendment of the criminal procedure law and anti-corruption investigative mode transformation. The author analyzes the transformation of investigative mode from perspective of detection value idea, concept, the concept of evidence, the concept of prosecution by means of science and technology. Therefore the necessity of anti-corruption investigative mode transformation is clarified.The second part turns to the discussion of the criminal procedure law and anti-corruption investigative path choice. The anti corruption detection of the path of transformation is informatization, which is an inevitable choice for enhancing the ability and efficiency of investigation. Interpretating from the anti corruption investigation information, anti-corruption investigative mode transition path detection information analysis. The author further revolves around the problem, clarifying the relevance of the detection capability, efficiency, the realization of social justice, the construction of a country under the rule of law.The third part puts forward the thinking on China’s anti-corruption investigative informationization construction. Relying on the procuratorial organ big cases investigation command center, create anti-corruption investigation information platform, realize information sharing network; construction technology investigation using the mechanism, enhance the ability to control the anti-corruption investigation; create electronic evidence using the mechanism, to provide new evidence for the anti-corruption investigation; strengthen the network anti-corruption construction, open up new ways of anti-corruption clues found; at the same time the anti-corruption the information concerned with civil rights protection, strictly standardize law enforcement, the case is to first check the donor, improve the quality of handling cases and the public credibility of the judiciary.
