Research On Legal Issues Of Care Services For The Disabled

China has more than8300million people disabilities, in this large group, mental, spiritual, and various types of severe disabilities are in a disadvantaged position in society. Most of disabled rely on their family.They are faced with high economic burden and mental pressure. We must resolve these problems as soon as possible. Care services for disabled have begun since2007. And it developed persistently in the period of the "Eleventh Five—Year". But there are still many legal problems. How to resolve these problems becomes a legal issue. This paper researches on several specific legal issues of care services for the disabled, and it finds the existing problems and puts forward the countermeasures.The first part is introduction. It mainly analyzes the research background and significance. Meanwhile it combs the research results about care services for disabled people and it summarizes research status at home and abroad. At last, it introduces major research methods and innovative points.The second part introduces the origin of the care service for disabled. It defines the related concepts, and analyzes the theory basis of care services for the disabled.The third part, analysis of several specific legal issues of care services for the disabled. Such as legislative problems of care services for the disabled, present. Contract problems of care services for the disabled, the problems of the tort of care services for the disabled, and dispute settlement mechanism of care services for the disabled.The fourth part, analysis of the existing problems for care services for disabled people in China. And it proposes the settlement for these problems:Completing legislation of care services for the disabled, defining the subject of care services contract, standardizing care services contract forms. The rights and the obligations of subjects should be clearly defined, defining the doctrine of liability fixation in infringement clearly, completing the dispute settlement mechanism of care services for the disabled, etc. Through these methods, we hope the legal system for care services is more and more perfect.The fifth part concludes the whole thesis by summarizing the key ideas of the thesis.
