In recent years all levels of government power to promote administration according to law to realize the grand goal of governing country by the law and establishing the government under the rule of law.Administration according to law in China has obtained the new results to comprehensively impel administration according to law as main line.Specific aspects are as follows.Firstly, hold a national work conference on administration according to law; secondly, promulgate and execute the suggestion of constructing the government under the rule of law;Thirdly, implement the administrative reconsideration duties; Fourthly,further standardize administrative enforcement law; Fifthly, promote government openness and improve government transparency; Sixthly, improve the administrative supervision mechanism; Seventhly, promote the citizen participation and administrative decision-making democratization;Eighthly, examine the rule. But there are some serious problems on our country administration according to law, especially the government at the country level. There is a tremendous gap for the government at the country level on administration according to law,compared with the requirement of the CPC Central Committee and the State Council and compared to the people’s desire of democracy rule of law.Concreting aspects are as follows.Firstly, there is a big disparity on the emphasis and efforts, compared to the requirement of the CPC Central Committee, the State Council and government at higher levels; secondly, there is a large gap on administration management’s intervention in the economic and social life for market subject hoping to have a free and loose development environment; Thirdly, there is a big gap on idea, way, means and effect of administrative enforcement law for basic value and target of administration according to law; Fourthly, there is a large gap on the low standard of administrative enforcement law for high standard and strict requirement of administrative enforcement organ and personnel; Fifthly, there is a large gap on the status and function of the supervision of the rule of law of the government for hard work of curbing the impulse of power. The problems above affect the relation between masses and cadre, damage the investment environment and the government image and curd production activity. The main cause of leading to these problems and gaps is that government at country level on administration according to law is lack of power. Therefore, how to enhance the power of the government at the country level on administration according to law is that we are facing a very important topic in theory and in practice.Motivation is a complex system, including many factors.
