The international criminal court (ICC), as the international community’ newattempt to further strengthen cooperation to punish the gravest and most seriousinternational crimes, should be independent, impartial, efficient and take them as itsbasic value pursuit and preconditions to ensure its vitality for a long time. Accordingto the Rome Statute, as the most positive and active factor in the judicial work of theICC, the Prosecutor who should be responsible for investigations and prosecutions hasa key role in the process to externalize the abstract international justice throughpunishing the most serious international crimes. Therefore, independence of theProsecutor is undoubtedly the critical factor to keep the independence and impartialityof the ICC. In the context, in order to deepen our understanding to the ICC’independent Prosecutor, together with the judicial practice of the Court, this articleaims to illustrate the history, the constitution, as well as the supervision of his or herindependence according to the Rome statute and other “black letter law” provisions,then prospect the relationship between China and this institution.
