| Starting with the connotation, nature, function and value of the legal supervision ofexecution of imprisonment, the article studies the history of Chinese legal supervision ofexecution of imprisonment and the system of foreign countries. On the basis of absorbingand drawing on the experiences of outstanding historical achievements and foreignsuccessful experience, the author discusses the status quo and existing problems of thecurrent Chinese legal supervision of execution of imprisonment by the method of systemmethodology. In that way, the author puts forward macro conception on the enhancement ofthe legal supervision of execution of imprisonment, and also the corresponding measuresand methodology suggestion. The paper can be divided into the following four parts:The first part defines the connotation and nature of the legal supervision of executionof imprisonment based on its legal principle. The author makes a deep analysis on itsfunction and value so as to lay a solid theoretical foundation for the following parts.By analyzing the present situation of the legislation and supervision of Chinese legalsupervision of execution of imprisonment, the second part carefully reviews the existingproblems in this field, and discusses the causes of the problems as comprehensive aspossible, thus preparing the ground for putting forward suggestions of the followingdiscussion.The third part, on the one hand, studies the history of Chinese legal supervision ofexecution of imprisonment. And on the other hand it makes comparison with foreignsupervision systems of the execution of imprisonment and draws a lesson from it, whichprovides reference to the improvement of the Chinese supervision of execution ofimprisonment.The fourth part is the core part of the paper. Based on the analysis above, the authoroffers the corresponding measures, which include the macro conception and the specificsuggestions on the perfection of the legal supervision of execution of imprisonment. |
