Research On The Social Responsibility Of The Legal System Of Pharmaceutical Enterprises In China

Enterprise is an important part of society, the survival and long-term development of theenterprise cannot leave the material support of the society, the harmonious development ofsociety also need enterprise bear the social responsibility actively. However, enterprises in themanagement always blindly, excessive pursuit of self-interest maximization goal, and ignorethe social responsibility. Pharmaceutical enterprises as one type of product-medicinecarrying the guarantee provided by the people’s life safety and the important mission ofphysical and mental health, so the quality safety of pharmaceuticals, pharmaceuticalenterprise’s social responsibility appears especially important, but in recent years,pharmaceutical enterprise society responsibility consciousness is indifference, damage causedby the increased medical events, pharmaceutical enterprise pollution destroy the ecologicalenvironment. To make pharmaceutical enterprises to actively undertake social responsibility,not only need to enterprises to set up the correct cultural values, also need a legal system ofregulation. Only to corporate social responsibility in the form of legal norms determine down,only have the function of the constraints, and guide enterprises and practical operability.This thesis document-structure constructed by four parts.In the paper the first chapter, mainly introduced the theoretical development of corporatesocial responsibility and special characteristics of pharmaceutical enterprises, for thepharmaceutical enterprise society responsibility established can reflect its industrycharacteristics model of corporate social responsibility.In chapter2, the thesis through reports and case studies, analyzes our country medicineenterprises lack of social responsibility, the present situation of the overall level is low.In the paper third chapter, the author focuses on the analysis of the present situation of thepharmaceutical enterprise society responsibility negative legal system. Through to the generallaw and the company law and other specialized medical legislation research, found that socialresponsibility legal system is not sound in China is a major cause of social responsibility isdifficult to practice.In the last chapter of thesis, the author combined with the third chapter, claims under thestatus quo of corporate social responsibility in current code for pharmaceutical enterprises toestablish social responsibility legislation framework, and enrich the legislative frameworkfrom the Angle of enterprise stakeholders in corporate social responsibility of the specificcontent and form a complete set of mechanism of supervision, and promote. In the last section,in view of the current our country legal environment to guide enterprises to actively undertakesocial responsibility policy, suggest to increase the enterprise tax deduction system and othermeasures to promote the enterprise bear the social responsibility to decision myself.
