The Improvement Of The Theory Of The Network Banking In Our Country Legal Regulation

In the1990s, the emergence of electronic commerce was expedited in accompany with the rapid development of network technology, thus, a new-type trading-internet commercial affairs came across afterwards in this environment, the development of which was in full swing from the appearance of network banks till now within merely twenty years. However, as a brand new matter, lots of legal issues need to be solved due to the incoordination between the existing regulations on online banking system and the speed of its development. Consequently, current laws and regulations were investigated to point out some drawbacks in our network banks for regulation, furthermore, detailed suggestions and proposals were put forward to establish the sound regulation system on network bank based on the assimiliation of advanced foreign experience for reference as well.Four parts is included in the whole text presented below. The first part is mainly an overview of the legal regulation on network banking. The concept and types of online banking was introduced followed by the vivid description of its transaction status and law regulation as well.The second part is the true analysis of network banking problems in China. The basic situation of network banking in China was described, then deficiencies of the regulation on network banking was pointed out by the illustration of three aspects:lower legislation level, inadequate protection of the consumer’s rights, and the insufficiency of the international communications and cooperations, followed by the exemplification using two actual cases to further elucidate the harm resulted from ineffective legal supervision in the end.The situation of foreign network regulation was introduced in the third section to obtain the enlightment that laws on regulation should be made clearly, regulatory system should be built perfectly, consumers’s interests should be paid more attention, and advanced experience of foreign countries should be learned more positively.Some suggestions were put forward in the fourth section according to the actual situation in China based on the introduction and analysis from the previous three parts above. The harm of lack of regulations in the second section and the enlightenment afterwards in the third part were taken into comprehensive consideration for reference to propose suggestions, to be specific, the basic principles in law regulation to abide by and improve, the promotion of right protection awareness and enhancement of cooperation.
