"Everyone has the appropriate housing" is an important issue faced by our country to improve people’s livelihood. However, the current hot real estate market lead to excessively high price of commercial housing, high housing prices in the city led to the housing difficulties of low-income groups increasingly apparent, if the problem is not solved effectively will lead to serious social problem. Chinese government is becoming more and more attention to this problem, has issued "low-rent housing","affordable housing" and "price commercial housing" and other policies to solve the housing of low-income groups.It achieved good social effects, solved the difficult problem of housing for many people.But those urban middle-income housing for needy families, new jobs no room workers and stable employment in towns such as migrant workers are neither meet the above criteria but difficult to market to solve the housing problem of the "sandwich class" group were excluded in addition to these policies.The housing difficulties problemof "sandwich class" group is still there,but the emergence of public rental housing system has well solved this difficult problem.Public rental housing system as an important part of affordable housing in our country plays an important role in solving housing difficulties of "sandwichclass"groups. Although public rental housing system has just started to develop, it is developing rapidly in our country, a large number of public rental housing appears to solve a lot housing difficultyof "sandwich class" group.It effective intervene the real estate market, promote the perfection of the housing security system, realize the sustainable development of the public housing resources, improving the system of the rental housing market.Public rental housing system in our country already has a certain development, however, it has just started, there are many drawbacks. Whether in the legislative practice, or in the legal system of public rental housing theoretical research are little, yet influential research appears. The research of public rental housing systemfocuses on the economics and management aspects.the research in the field oflaw is still relatively small. Public rental housing in our country legal system is not perfect, only by the department of regulations and policy documents, etc. To manage public rental housing. However, these legal documents widespread has lowlegislative level, the lack of a unified national legislation, and so the question. In specific provision, the object and requirement of public rental housing is not perfect, the lack of public rental housing management mechanism, public rental housing lease term and the exit mechanism of the defects of the unreasonable and so on.So, this paper aims to study the existing outside of relatively perfect legal system of public rental housing, comparative analysis of the flaws of the legal system of public rental housing in our country, and the advanced experience of other country, combined with the actual situation of our country, put forward the corresponding perfecting suggestion. In this paper, the integrated use of literature analysis, comparative analysis and the method of inductive analysis and so on, to perfect our legal system of public rental housing, making it a multi-level and comprehensive security legal system of housing security, promote social harmony and progress.The structure of the main text of this paper is divided into four parts. The first part is "the summary of the legal system of public rental housing ",This part mainly expounds the concept of legal system of public rental housing and the concept and basic features of public rental housing in our country, discusses the practical significance of the legal system of public rental housing, and from the law perspective of the origin of the legal system of public rental housing legislative situation.The second part is "outside public rental housing legislation and practice and reference", this part analysispublic rental housing legal system of the legislation and practice of Britain, the United States, Germany, Singapore and Hong Kong, illustrates the public rental housing legislation and practice of other countries and regions in the development of our country’s public rental housing is available for reference. The third part is" the problem of public rental housing law system in our country", this part through the analysis of the law of public rental housing in our country and local regulations and policies, etc., combining with the present situation of the public rental housing system in our country, analyzes the legal system of public rental housing the main problems existing in legislation and practice. The fourth part is "the suggestion of perfecting our country’s legal system of public rental housing", this part reference the advanced experience of other country, in view of the current legal system of our country public rental housing of all sorts of problems, put forward some basic principles and specific recommendationsto perfect our legal system of public rental housing.
