The right of residence is not only a basic human rights, but also an important issue for our government to improve the livelihood of the people. Since the1990s, the Chinese government since the housing system reform, especially in the construction of affordable housing and low-rent housing, has made great strides in development, solves the problem of the housing difficulties of some people. With the speeding up of urbanization process in China, the urban population rapidly expand, so he created a series of housing problem:higher family income and have the purchasing power of this group can be through the purchase of commercial housing to solve the housing problems; In the lower income families and have a certain purchasing power but can’t afford to buy commercial housing this group can purchase affordable housing to solve the housing problems; Cannot afford to buy was unable to buy commodity house and economy applicable room of low-income groups could be provided by the government or the unit to solve the housing problem of low-rent housing. But in the town of the housing difficulties of low-income and family, graduate students and migrant workers housing interests of this group is not guaranteed, they don’t have enough economic capacity to buy commodity house and economy applicable room, also does not meet the requirements for the application of low-rent housing, and so on the housing guarantee system in the vacuum zone, we call this group sandwich layer. In June2010, the ministry and other seven ministries jointly issued the opinion on accelerating the development of public rental housing, designed to protect the interests ofsandwich layer housing, and points out the significance of development of public rental housing. In subsequent years, public rental housing began with the development of our country, and has obtained some achievements, but also exposed some problems in the process. The purpose of this paper is to analysis problem of public rental housing system in our country, and the problem puts forward Suggestions for the public rental housing system in the evening.This paper is divided into three parts:introduction, text and conclusion. The main text is divided into four parts, the main body of this text is as follows:The first part mainly analyzes the basic situation of the public housing in our country, including the concept, development process, and characteristics, comparing with other housing safeguard way and the significance of construction of public housing.The second part mainly analyzes the necessity of developing public rental housing, including the necessity of constitution and the necessity of economic law..The third part mainly analysis is the current situation of the development of China’s public housing and existing problems, combined with four typical cities of Beijing, Shanghai, Shenzhen, Wuhan, China’s public rental housing system in all aspects of the level of legislation, supervision mechanism, access and exit mechanism, Zu Jinli, capital source channel and existing problems are pointed out.The fourth part is mainly from the reality of our country, and put forward to improve our public rental system proposal.
