The women’s equal employment right is one of basic human rights for women’ssurvival and development, is a fundamental right of our Constitution gives women’sbasic rights. With the progress of human civilization, the development of the feministmovement, women’s social status is constantly increasing, more and more womenbegan to get rid of client identity, enter the labor market in succession. In1992wepromulgated the "the people’s Republic of China Women’s rights and interestsprotection law",the law from the female point of view was formulated specificallyfor women’s rights protection,the law is the comprehensive protection of the rights ofwomen. Subsequently promulgated "people’s Republic of China Labor Law of thepeople’s Republic of China","Employment Promotion Law" also on the protection ofwomen’s rights and interests set up special section, clear the women enjoy the equalrights of employment with the male, enough to see the country attached greatimportance to the protection of women’s rights and interests.But in recent years, women in the employment discrimination phenomenon isnot the case, but very common. According to the authoritative social survey, sexdiscrimination in employment of women in employment in the stage of the mostsevere and widespread, here the discrimination both in recruitment clearly putforward as long as the dominant male requires direct discrimination, also has not beenclearly put forward only recruit male requirements in the recruitment process, but inthe actual operation of the exclusion of women hidden indirectdiscrimination.Therefore, the prospect of women in employment in the field of reallyworrying, how to solve the problem of employment discrimination of women, hasimportant practical significance to protect women’s equal right to employment.The first part, mainly is the basic theory of law on the women’s equal right toemployment, the complex relationship between clear right to employment and laborrights, analyses and discusses the connotation of women’s equal right to employment,welfare equality from the equal employment opportunity, employment equality ofconditions, post employment to analysis. The second part, is an important part of this paper, this part is to realize thelegislative status and rights of women’s rights in China from the angle of empiricalcase. The paper quotes a large number of reliable data from the survey, employment,labor remuneration, retirement age, women’s political participation of rural women,landless analysis discrimination women in these areas.The third part, through the analysis of the discrimination of women inemployment, digging deep-seated reasons affecting women’s equal right toemployment, the main reasons are "men outside, women inside the feudal ideologyof" traditional and backward and the insufficiency in legislation, law enforcement,judicial aspects, resulting in a lack of sufficient strength to women’s equality the rightto employment security.The fourth part, based on the foreign and China’s Hong Kong region on theprotection of the right of women’s equal employment legislation, summarizes theiradvanced experience, combined with China’s basic national conditions, to learn, Ipropose to our country women’s equal right to employment security implications.The fifth part, is the last part of the text, but also the key part, through theanalysis and Research on the above problems and causes, to explore the strategies ofChinese women’s equal right to employment to achieve the perfect. Realization ofwomen’s equal right to employment depends on the efforts, so this paper mainly fromthe legislative, law enforcement, judicial aspects make their own suggestions ofimprovement.
