In China today, toxic and harmful food have became daily news. Almost every citizen are suffering from unsafe food and even pathetically getting used to it. Repeated food safety incidents have a common fixed format:"The media exposure "," Public criticism"," Accident management" and "New food safety incidents ". Series of food safety scandals make people in China no longer believe the food quality and safety. Meanwhile, all kinds of Food safety meeting and even more joint law enforcement, carried out by government, seems useless. Existential predicament in food security exposed many problems in food quality administrative systems and traditional administrative law theories, for example, legal system and legislative idea lag, lack of public participation, inefficiency regulation. In this article, I hope my research, Cooperative administrative regulation of food quality, can discover a way to innovate the administrative systems and meet requirements of a functional regulation of food quality and even drive the development of the administrative law science. Full-text is divided into four chapters:Chapter one:Theory analysis of Cooperative administration. Cooperative administration, which main objective is complete mission of public governance, need be used in whole phrase of administration regulation. Compare with traditional Administrative Law theory, Cooperative administration, which focus on problem solving, has different explanation about what role government and private play in administrative act, such as administrative legislation or administration regulation. Cooperative administration believe public-private partnership(PPP) can be a functional mode to run public power and shoulder the administrative responsibility.Chapter two:Studying administrative food quality and safety regulation status of our country from cooperative administration theories perspective. By seeing through the appearance to perceive the essence, we can find that unbalance public participation, the capture theory of regulation in government, the expert’s irrational and lack of democracy are internal problem of our administration food quality and safety regulation. Chapter three:The value of cooperative administrative regulation of food quality. The real value of cooperative administration are best solution to make up the lack in regulation of food quality today. Cooperative administration, which not only can refine administrative responsibility system, but also can construct a good market environment, and even can promote democracy in administrative regulation, will form a self-healing food quality and safety regulation system.Chapter four:Proposal of use cooperative administration theory in food quality and safety regulation. By using the experience of cooperative food quality and safety regulation in Britain and Germany for reference, I will propose the ideas of use cooperative administration theory in food quality and safety regulation,which based on principle of transparency, the strict responsibility and cooperated-governance. Government, public and market can work together, with a series of legislation and the administrative legislation, to construct a new food quality and safety regulation system.
