Research On Food Safety Regulation By Cooperative Governance

The issue of food safety is related to people's livelihood and it is one of the most important issues that human society will face.The food safety situation in China is grave,and frequent food safety accidents seriously threaten people's life and health.There are many reasons for causing food safety problems,the most important being the lack of food safety supervision.In the field of food safety,China is an authoritative regulatory system that is built on the state power and centers on the theory of “management theory” and pursuing a regulatory center.The government has become the sole subject of food safety supervision,and the public can only obey and cooperate unconditionally.Such regulatory practices have led to the confrontation between the government and the society,and have also led to the failure of the food safety regulatory system.The contradiction between the complexity of food safety issues and the limitations of government capacity has made food safety supervision a “impossible task for the government”.Therefore,the path of food safety supervision in China needs to be changed.Under the background of the diversification and complexity of modern public administration affairs,the traditional administrative model based on absolute government power has been unable to adapt to the needs of contemporary public administration,and cooperation governance has emerged.Cooperative governance is not only a new mode of public administration,but also a new concept.Cooperative governance advocates the diversification of the main body of governance.Under the leadership of the government,social groups and the public are introduced to participate in public affairs.In the field of food safety,cooperative governance is a development direction of China's food safety supervision.The study of this article starts with the issues of food safety supervision.The first part analyzes the existing difficulties in China's food safety supervision.It discusses what is the predicament of supervision and its causes from five aspects: subject dilemma,legislative dilemma,law enforcement dilemma,institutional dilemma,and social dilemma.,Then come to the conclusion that food safety supervision needs cooperation governance;the second part introduces the connotation of cooperation governance,including the main body,scope,methods,distribution of power and responsibility,and dispute resolution;the third part discusses the governance logic of cooperation governance.Including its legitimate issues in public law,the characteristics of cooperative governance,and the existence mechanism of cooperative governance;the fourth part proposes the institutional conception of food safety supervision,constructs relevant systems with humanism,and advocates the subjective initiative of human beings.Food safety supervision and management areas to achieve cooperation and governance.
