The consumption of mineral resources,in China,has dramatically increasedfollowing the rapid development of economy in recent years,and there has beengrowing attention on the mining rights transfer。As market behavior,mining rights transfer presents different transactioncharacteristics under different markets and policies. This paper focused on the stagetrend of mineral rights transfer to summarize its development,investigate thecorresponding influences,summarize the rule and analyze the trend based on therepresentative coal mining industry in Shanxi province thus further providingguidance for healthy development of mineral rights market.The transfer of mining rights can be divided into three stages, each stage has acorresponding historical period, policy attitudes and market transactions,The firststage started from reform and opening up to the end of20th century in which thepolicy was characterized by the transfer of mining rights from the prohibition togradually liberalized, and the purpose of market transactions was to acquire themineral resources corresponding to the mining rights transfer. The second stagestarted from2001to2010in which the transfer of mining rights policy wascharacterized by the gradual tightening of policy so that the purpose of markettransactions was to make a profit by the difference between the prices of the transferof mining rights. The third stage starts from2011to date, the characteristic of thenational policy is to maintain the current policy, and the mineral rights transfertranscation is transforming to the financial market in the form of the securities and thetrust.By analyzing the staged trends of transfer of mining rights,,the followingconclusions were drawn.First, the transfer of mining rights policy specification is apart of the national macro-control,consistent with the national macroeconomicpolicies. Second, the transfer of mining rights is in line with the developmental trendof the law of the commodity economy, and the market allocation of resources thatplays as a leading role becomes clear. Third, interactions do exist among the various stages of their own policies and markets. There is a certain overlap in each stage andthe latter stage developed based on the previous stage.There are five sections altogether in this paper. The background andimplications of the thesis were introduced in Sections one.A statement about thedefinition and fundamental theory of mineral rights transfer was given in Section two.Brief introduction about mineral market from the perspective of policy and marketwas presented in Section three. Analysis based on the current status of mineral rightstransfer and its changes attributable to the current policy and market was conductedand the developmental trend of mineral rights transfer was also summarized inSection four. Guidance for better policy about mineral rights transfer was provided inSection five.
