Research On Issues Of The Subject Of Community Correction

Community correction that putting criminals on social transformation is apenalty of punishment, it corresponds with a sentence of imprisonment. Comparedwith a sentence of imprisonment, community correction reflects better socialization,democratization, but also the people-oriented penalty humanitarian values. From thebeginning of2003, our country tries to apply community corrections to criminal thatsentenced for surveillance, detention, probation, parole, deprived of political rightsin some areas. To2009, some criminals in certain conditions have been appliedcommunity corrections in a nationwide. Then and now "Criminal Law AmendmentEight" writes community correction into Criminal Law, Our community correctionhas made certain achievements, and accumulated some experience. Meanwhile, withrespect to a sentence of imprisonment penalties measures, the advantage ofcommunity corrections that the way of non-custodial penalties is appearing in theprocess of reforming criminals. Such as community correction is more conducive tocriminals into society, can effectively avoid the stigma of crime, can an effectivelyintegrate the execution of judicial resources and reduce costs. But at the same time,community correction also appeared in a variety of problems, such as theclassification of the subjects of community correction is not clear, the importantposition of the judicial administrative organs fails to obtain legal recognition, thejudicial administrative organs lack of the power of mandatory detention, the level ofparticipation of community subjects and community involvement correctionvolunteer is not high, the stability of community corrections workforce is poor andnon-professionalism, community corrections failed to uncover the important role offamily members, community corrections oversight body is inadequate supervisionand so on.In order to make the research of the subjects of community correction base onrelative scientific method, this paper starts defining the concepts of communitycorrection, analyzes current problems of the subjects of community corrections fromthe perspective of both legislation and practice, combining with the knowledge learned in undergraduate period, proposes a number of ideas to solve the problem ofthe subject of community corrections in China.
