China has a vast territory and complicated geological environment, which causedthe frequent,intense and big geological disasters in many distribution and varioustypes, the annual losses caused by geological disasters accounted for more than20%of natural disaster loss. With the increasing intensity of human engineering activities,geological disaster has gone into the multiple phase, no doubt it will be one of themajor natural disasters we have to deal with in a period of the future. Improve theadministrative emergency capability in geological disaster, has became not only theinevitable request of improve public servic,but also an important part of the Chinesegvoernment’s transformation.The first part of the article is an introduction, introduces the research backgroundand research content of the thesis. Explained the shortcomings of the currentadministrative response mechanism in practice, proposed theoretical research andpractical significance.The second part discussed some underlying concepts of administrativeemergency mechanism of geological disaster. Firstly, clarified definition andclassification of geological disasters, pointed out sudden geological disasters as theobject of this study; Secondly, define administrative emergency powers from both theconnotation and extension; Thirdly, makes a distinction between emergencies andstate of emergencies, to clarify the administrative character of emergency; What’smore, proposed the principle of exercising administrative emergency power.The third part is the main content of the article, analyzed China’s currentadministrative response mechanisms of geological disasters. Firstly sorted out thelegislative system of geological disaster emergency, thereafter in accordance withprevention and emergency preparedness, monitoring and early warning, disasterdisposal and rescue, recovery and reconstruction these four stages, combined withpractical analysis of the effects of the emergency operation mechanism, and proposeddeficiencies.The fourth part of the article described the legislative system, emergency response organizations, and successful experience in terms of geological disasterresponse mechanisms of the United States and Japan.The last chapter made recommendations of the administrative emergencyresponse mechanism of geological disasters, from two angles:strengthening legislativesupport and specific system construction. To be specifical, we should improve thelegislative system, build a unified emergency response platform, enhance theemergency response capability of local government, and proceed with specific systemconstruction of the emergency response mechanisms.
