The Legal Regulation Of The Auxiliary Police Behavior

The behavior of auxiliary police is particularly important because the social status need for security urgently and our society is lacking of police.China is a populous country that has many complicated social security problems,the policemen can hardly solve the problems.So a new group which is called auxiliary police has emerged.It is a dangerous thing that there is no law or regulations to regulate the actions of auxiliary police.Because they have some powers of the police,but there is no constraint on them,so it may lead to the powers of abusing.Because there is no legal regulation,the rights of auxiliary police cannot be guaranteed,thus causing more illegal and criminal acts.So the regulations of auxiliary police should begin with the legislation,perfecting the access of auxiliary police,improving the route of evaluation and training and enhancing the benefits of them.So as to regulating the acts of auxiliary police better,protecting the rights of them and and making more contribution to our society.The first part of this article starts from the concept and characteristics of the auxiliary police,and then make an analysis on the character of auxiliary police that they are administrative authority acts,acts of administrative delegation or administrative support person. And put forward my views and ideas.The second part of this artical starts from the necessary of the auxiliary police,and analyzes the importance of the auxiliary police in our society management.But there is no legal to regulate the acts of them,so it is leading anomie behaviors.The anomie behaviors performance for improper acts,violations and criminal acts.Author through some cases to descrip the dangerous of the anomie behaviors of the auxiliary police to our nation,society and people.At the same time,the author also analyzes the reasons of the anomie behaviors,including lacking of legislation,inadequacy of recruiting,examing and training system,and the rights of auxiliary police protecting insufficiently.Last part of this article is the recommendation to the legal regulations of the auxiliary police.The author put forward basic principles that auxiliary police should follow them,and the system of powers and responsibilities constructing should accord to them.The principles include the principle of administration by law,reasonable administrative principles,principles of due process,efficient principles,principle of good faith and the unification of the power.Firstly,the government should legislate the regulations of the acts of auxiliary police. When the auxiliary system is established,the acts of auxiliary police can go by it,avoiding arbitrariness and diversity,so the auxiliary police can get the road which is normalization and legalization. Secondly,the recruiting system of auxiliary police should be perfect,because it is very important to the quality of the auxiliary police.Only do like this,can we enhance the quality and combat effectiveness of the auxiliary police.At the same time,the auxiliary management system should be improved and perfect,the system of assessment and training evasions and dismissal mechanism also should be perfect.This system can stimulate the enthusiasm of the auxiliary police.Last but not the laest,the benefits of the auxiliary police should be increased to fully protect their rights.This is the only way to better serve the community and our society will be more harmonious and orderly.
