Research On The Legal Question Of Auxiliary Police's Rights And Obligations

When we talk about auxiliary police,maybe all of you know a little about of this word.But,when we ask some questions like "Who is auxiliary"?What obligations should auxiliary police undertake,maybe nobody can give us an answer because of lacking of law about auxiliary,and the definition of the auxiliary police,rights and obligations of boundaries are fuzzy,so that the phenomenon of absence and unauthorized of auxiliary police happens frequently.That would make some auxiliary police can't play their positive effects,at the same time,even will affect people's confidence in the auxiliary police,that will be not conducive to the harmonious development of the society.Therefore,I not only carry on the research about the auxiliary police,but also the legal rights and obligations of the auxiliary police system in China.I hope this paper can have a good effect on our auxiliary police system.There are four parts in this paper:The first part:Describing of auxiliary police.This part will be taken from the definition and the classification of the auxiliary police.First of all,the author defined the auxiliary police,detailing the auxiliary police origin and the development of the auxiliary police definition,at the same time,the author thinks that,auxiliary police produced in public relations,and should be positioned as the auxiliary police personnel.The second part:The problems of auxiliary police's rights and obligations.This part is the focus of this article.Problem firstly embodies in the ambiguity of the legal status of auxiliary police,he does not belong to the system establishment,and impressed the crowd just stay in the "temporary workers".Secondly,the problems embodied in the rights of the auxiliary police boundaries are not clear,what's more should auxiliary police own law enforcement is still debated.Finally,the problem also reflected in the relevant auxiliary police compulsory regulations and the actual performance of the conflict,namely the scope of the obligations stipulated in the law is very fuzzy,auxiliary police actually perform obligations.At the same time,it is also not appropriate to perform,thus caused the conflicts between them.The third part:Analysis of the causes of problems existed in the rights and obligations.This part analyses the problems existing in the second part,the author thinks that there are three main reasons,respectively are:the lack of legal support,the lack of management and supervision of auxiliary police,low professional quality of auxiliary police.The fourth part:the path of perfecting the system of the auxiliary police rights and obligations.This part is a key part of this article,mainly for the analysis summary of each part,and put forward new opinions about the improvement in the rights and obligations under the existing about the improvement in the rights and obligations under the existing auxiliary police system of our country,there are three main opinions.First of all,it is necessary to draw up unified auxiliary police rights and obligations for content of specialized laws and regulations,to clear the name of the auxiliary police in rules and positioning,give the auxiliary police clear legal status,clear boundaries and auxiliary police rights,what's more,the law also should refine auxiliary police's duty.Secondly,the management department should strengthen the supervision and administration of the auxiliary police team.Finally,the external forces and auxiliary police itself will strive to improve the professional quality of the auxiliary police team.I hope that through the analysis of the auxiliary police rights and obligations,I can put forward some useful advice for the auxiliary police team construction in our country and contribute our strength.
