Compulsory education occupies an important position in the whole education process, is the foundation of other education. It plays a decisive role in shaping the personality and developing good habits. The article first generalize complaint system of compulsory education student. Analyzes it from three aspects, The concept of compulsory education student complaint system, the need for establishing compulsory student complaint system and the characteristics of the system. Student appeal rights are the rights conferred by the Constitution and laws as a relief right. The legal rights want to be turned into specific right, must build and improve students appeal system of schools and departments for education administration. The appeal system of compulsory student is the institutional guarantee for students the right. It is a concrete manifestation of student appeal right in the legal relationship of education administraion. It refers to students who are in the compulsory education stage,when their rights are violated from the schools or teachers’ behavior, appeal to the specialized agencies of school and the administrative departments of education, complaint system. Compulsory students are different from the ordinary student characteristics. Establishing compulsory student complaint system has practical urgency and necessity, we should give enough attention. The second part of the article introduce present appeal system of china’s compulsory education. The status quo of China’s Compulsory Education student complaint system is worrying. There are no special provisions for compulsory students in the legislation. the compulsory and non-compulsory student complaint system confused. Most schools and educational administrative departments don’t have independent appeals body norms, even if there is a complaint mechanism, agencies personnel is unreasonable and unscientific. Complaints range of students is not clear, or too general, lack of maneuverability, or does not comply with compulsory features. The appeals process is not specific procedural rights and procedural system.as the core of the complaint system, which directly affects the outcome of the complaint reasonableness and acceptability. Affected by a long tradition of thinking, awareness of the law students and parents weak, the relative lack of awareness of rights, is not conducive to promoting student complaints system. In short, at present, there are more problems about compulsory education student complaint system, regardless of the theory or the practice.The last part of the article focused on the above problem, put forward the the response measures and specific programs. We need a special legislative redress system of compulsory education,not only depend on the legislative reference of colleges and universities. In addition, regulate the composition of personnel appeals committee and reduce the proportion of administrative staff, adding law, education professionals, increasing student and parent representatives and ensure the characteristics of relative neutrality complaints mechanism. Further clarify and refine the scope of the complaint, the scope complaints of "Education Law " is too general and should develop detailed and broad scope of the complaint based on the characteristics of compulsory education. The appeals process is refined specific operational procedures and establish a series of system, such as the collegiate system, avoidance system, the hearing system. Gradually strengthen legal awareness of students and parents, to play the role of parental supervision and management.
