As the carrier of high-tech industry, the high-tech development zone has becoming matured slowly after decades of development. Since the late1980s, our country began to establish the high-tech development zone, now has been developed for over20years. Guiding by this new model of economic development, local levels actively build high-tech development zones, to develop high-tech industries, the scientific strength and economic levels of our country has reached a remarkable height in the world.With the gradual deepening of the development of high-tech development zone, and the nation’s progress of legal process, there are a lot of problems that we hace to meet during the development of high-tech development zone. But these problems often can not be solved because of lack of existing laws and regulations, this need more comprehensive laws and regulations to provide an institutional guarantee for the development of high-tech development zones. According to the experience of high-tech development zones and legislation that in developed countries, and combined with the legislative realities in our country, it is not difficult to find that there are still many problems of high-tech development zone that to be solved. Among these problems, the most prominent problem is the lack of basic laws and special laws that for the high-tech development zone, this thesis strive to analyse the development status of Chinese high-tech development zone and it’s legislation from four parts, and made perfect views at the same time. Firstly, the paper will introduce the overall situation of Chinese high-tech development zones, and explain the background of current legislation; Secondly, the paper will analyse legislation status and the problems of Chinese High-tech Development Zone; then, the paper will learn the successful experience about the legislation of high-tech development zone that in foreign countries; Finally, the paper will put forward the recommendations for legislative perfection of the high-tech development zones from seven directions.Only by legislation, that our high-tech development zone can have healthy development with institutional protection, and can improve the technological content of our high-tech industry through the development of high-tech development zone, and promote the rapid economic growth that to enhance our comprehensive national strength.By analyzing and researching form the paper, it can provide theoretical support for the legislative theory work about the high-tech development zone, while strengthening the understanding of the legislative theory for author, and then carry out innovative thinking in the protection of regional economic laws.
