Legal Issues In Food Safety Under The "SPS Agreement" Framework

"Agreement on the Application of Sanitary and Phytosanitary Measures"is animportant outcome of the Uruguay Round of GATT talks,is to ensure that an importantmultilateral trade rules for the smooth development of international trade,a newframework of the multilateral trading system. This paper attempts to "SPS Agreement"the background, content and purpose of the interpretation of the necessity of itsexistence,analyze their problems apply in specific cases raised by,combined with thestatus quo of China’s current food safety law implementation analysis of the currentproblems, and then propose appropriate countermeasures. The article is divided intofour parts.The first part is an overview of food and food safety. Briefly describes therelationship between food security and international trade,and the introduction of foodsafety in international trade legal system to adjust.From the aspect of the second part ofthe background, content, and guiding principles of the "SPS Agreement" foranalysis,and describes the "SPS Agreement" among food safety requirements.The thirdpart of the law on the status of our country’s food security analysis to point out the legalconstruction of China’s food safety problems in the process of.The fourth part focusedon the legal system of China’s food safety deficiencies in the process to introduce theperfect legal system of China’s food safety measures and recommendations.
