The Study Of The Legalization Of The Sports Association At The Provincial Level In Henan Province

As an important organization of China’s sports development, sports association is an irresistible trendfor the innovation and development of China’s sports management. Following the rule of law is aninevitable choice for the development of the sports association. The existing problems in the developmentof the sports association declare the need for the legal system, which is emphasizing, systematizing,normalizing to administer the sports association. As the link between the national and city/county levelsports groups, the provincial sports association is in crucial position in the development of the whole sportscause. Therefore, taking the provincial sports association in Henan Province as an example, this paper isgoing to discuss the legalization of the provincial sports association, so as to push forward its legalization,promote its healthy development and to provide references for the legalization of China’s sportsassociation.By adopting documentation method, investigation method, mathematical statistics, logical analysis,etc. and involving related concepts, ideal rule of law and the background study of the legalization ofChina’s sports association, this paper analyzes the essence of the legalization development of the sportsassociation in China from the aspects of legislation, law-enforce, law-abiding, judiciary and supervisingand furthermore investigates the current situation and existing problems in the legalization of the provincialsports association in Henan Province. The conclusions are as following:1. It is short of related laws and regulations. There are no laws about the legalization of the sportsassociation and the existing laws and regulations are more of administration, which are lack of operability;2. There is too much intervention from the government and the sports association is lack ofself-management. The provincial sports association in Henan Province is too dependent on the government.The foundation, naming of the principals and the decision-making of the association are all interfered bythe government, which constrained the development of the association.3. It lacks in standard management in the association. The organization of the association is defective,which goes against the standard management, causing the self-discipline and inside-supervision to beunattainable. Moreover, the regulations of the sports association are not wholly implemented and the regulations are lack of practical application.4. The judicial system is lagging behind and it lacks in judicial intervention. Thegovernmental-managed association and the lagging behind of its legal sense drive it away from the lawfacing legal issues or disputes. Therefore,“no problem” becomes the biggest problem in the sportsassociation.5. The supervision system is deficient and the governmental supervisor is not useful. The onlyexisting annual check is not effective; the organization is defective---the council, committee are of no use;it lacks in insider-involvement and supervision channels; it also lacks in social supervision for being notopen enough to the public.Based on investigation, suggestions on the problems during the legalization of the provincial sportsassociation in Henan Province are as following:(1) to complete related laws and regulations, providinglaws for the association to abide by;(2) to transform the function of the government to realize theself-government of the sports association;(3) to complete the institutional framework and standard theregulation management;(4) to enhance the judicial intervention to complete the association judicial system;(5) to complete regulations of association supervisor system.
