Recently the aging population of the society with the fast socio-economic development of the country China is becoming an aging society. Therefore the retirement pension system (RPS) reforms became a focal point among the society. Throughout the legislation of RPS, China has formulated the laws and administrative regulations about the RPS. With the documents about the RPS released by the State Council and the new regulations addressing the RPS made the relevant departments and local departments to specify the detailed norms for the system.The scholarly works has been made on the use usually from the Sociology and Economy disciplines; however there is not much study made by Law scholars. Among these studies there are some important achievements, nevertheless the need for new studies remained with the new developments over the passing time. That is why this research is expected to use the literature on the China’s RPS theories and make a comparison analysis with the China’s and overseas RPS systems. By doing so it is expected to draw conclusions on the applicable and logical recommendations on the China’s RPS.This work in the introduction part will introduce the background, the significance of the research and also will discuss the methodology and theoretical framework. Than the main body consist from three chapters. The first chapter will introduce an outline of the Elderly Insurance System (EIS) law and will draw out its effects and relations on RPS law system as a model. The second chapter, with looking at the RPS law legislation procedures and the current situation, will evaluate RPS law system’s achievements and drawbacks. The third chapter will be the conclusion about making some possible suggestions to the Chinese RPS law framework with regarding the current socio-economic environment and evolution of China. |
